1. What you are buying

FanAvatar is an AI-powered self-portrait stylization service. You upload a selfie of yourself, and our AI returns a stylized portrait of you in World Cup 2026 fan themes (face paint, generic athletic jersey, or stadium background). FanAvatar is not a face-swap, deepfake, or face-manipulation tool; we do not transfer faces between subjects.

2. Eligibility

You must be at least 18 years old (16 in the EU) to use FanAvatar. You must upload only photos of yourself, taken by you or with the subject's explicit consent if it is a clear self-portrait you legally own. By uploading, you represent that you have all necessary rights and consents.

3. Acceptable use

Detailed rules are in our Acceptable Use Policy. In summary, you agree NOT to:

• Upload photos of anyone other than yourself, or photos of minors.
• Generate NSFW, sexual, sexually suggestive, violent, hateful, or harassing content.
• Generate content that infringes anyone's intellectual property, trademarks, or likeness rights.
• Use FanAvatar for face-swap, deepfake, identity fraud, KYC bypass, or any deceptive practice.
• Bypass watermarks, paywalls, prompt filters, or rate limits.

Every prompt is screened by an automated content-moderation layer before generation. Disallowed prompts are rejected with no charge.

4. Ownership and license

You own the avatars you generate from photos you legally have rights to. You may use generated avatars for personal AND commercial purposes, including merchandise, social media, livestream overlays, etc.

FanAvatar retains the right to use generated avatars (anonymized) for marketing samples unless you explicitly opt out via email.

5. Not affiliated with FIFA

FanAvatar is not affiliated with FIFA, any national football federation, or any team. Generated avatars do not include team logos, badges, or trademarked elements. "World Cup" references are nominative use only.

6. Refunds

7-day money-back guarantee on all paid plans. Email us at hello@fanavatar.org for refund requests. If your first generation fails for technical reasons, we automatically refund or top-up credits. Refunds are not available where the violation of this AUP is the cause of refusal.

7. Service availability

We aim for >99% uptime but provide no guarantee. AI generation may occasionally fail. Failed generations do not consume credits.

8. Liability

Service is provided "as is". Our maximum liability for any claim is limited to the amount you paid in the previous 30 days.

9. Termination

We may suspend or terminate your account for violation of these Terms or our Acceptable Use Policy. Verified violations of the AUP — including but not limited to NSFW content, content involving minors, face-swap attempts, or fraud — result in immediate termination, deletion of generated content, and where appropriate, referral to law-enforcement authorities.

10. Payments

Payments are processed by Creem.io as Merchant of Record. Creem handles all card processing and applicable taxes. We never store your card details.

11. Changes

We may update these terms. Material changes will be announced via email and on this page. Continued use after changes means acceptance.
